(1) The duties of the manufacturer, importer or supplier of any equipment, item or substance used in the workplace shall be as follows:-
(a) To produce, import and supply equipment, goods or substances which are suitable for operation and use at the workplace from the point of view of safety and health,
(b) Determining the methods and procedures for operating or using such equipment, items or substances in an appropriate manner so as not to adversely affect the safety and health of the persons concerned at the workplace,
(c) Detecting the danger that may adversely affect safety or health from the use of such equipment, article or substance,
(d) To carry out research, experiment or test necessary to eliminate or reduce the danger discovered in accordance with clause (c), but to recognize such research, experiment or test if there is reasonable ground to believe in the results of any research, experiment or test already carried out by someone else in that regard. will end.
(e) To prepare a directive to fully inform about the necessary things to be adopted from the point of view of safety and health while operating and using the equipment, goods or substances used in the workplace.
(2) Individuals and organizations that manufacture or install equipment used in the workplace shall submit a written report to the employer stating that if the equipment manufactured or installed is used in a suitable manner, it will not adversely affect the safety or health of anyone.
(3) If the manufacturer or supplier providing any equipment, item or substance does not use such equipment, item or substance in accordance with the information or advice provided regarding the use of the equipment, item or substance, such equipment or substance shall not be considered to have been used appropriately for the purposes of this section. दधाध (4) The manufacturer, importer or supplier of any chemical substance used in the workplace shall provide the employer with the chemical safety data sheet (Chemical Safety Data Sheet) and other details as specified in relation to that substance.
